A condom found in the loo of a 32-year-old man's Gloucester home proved he'd had sex with a 14-year-old girl, a jury was told today.
Police, who were hunting for the girl after her father reported her missing, found her in the home of Karzan Elias in Chelsea Court, Southgate Street at 6.30 am on 11th June 2012.
When officers arrived at the house they saw the girl coming downstairs - and a search of the property revealed the condom, said prosecutor Virginia Cornwall.
Forensic scientists were able to identify both their DNA on it, said Ms Cornwall.
Elias maintained when arrested that they had not had sex, she said.
Later, however, when the scientific evidence revealed the girl's DNA on the condom, Elias changed his account and accepted having sex with her but said he did not know she was under age.
Elias has pleaded not guilty to having sexual activity with a child.
Ms Cornwall told the jury the girl had met Elias in a shop when she was with a friend of the same age.
It was the prosecution case that Elias knew her age from that time because the friend told him, said Ms Cornwall.
She said that over the ensuing days Elias repeatedly texted or phoned the girl.
He addressed her 'Hi baby' and sent kisses to her, Ms Cornwall said.
There had been 31 texts in similar vein and Elias had also phoned her more than forty times, she added.
The girl's father reported at about midnight on June 10 that she was missing and officers traced her to Elias' home.
The trial continues tomorrow.
